What is a class action?

A class action is a legal proceeding that allows one person to act on behalf of a group of people with identical or similar legal claims. A person called the “class representative” is authorized to act on behalf of all members of the class in court. This avoids each member having to file an individual lawsuit: the court handles the case in a single proceeding for all concerned members.

What is the context of these class actions?

These class actions have been authorized against Station Mont-Sainte-Anne Inc. on behalf of individuals who were aboard the gondola lift operated by Station Mont-Sainte-Anne Inc. during the malfunctions that occurred on February 21 and March 11, 2020.

Who is covered by these class actions?

These class actions are open to all individuals, including minors, incapacitated persons, and deceased persons, who meet all of the following criterias:

  • You were inside the gondola lift at the Mont-Sainte-Anne ski resort;
  • When it came to an abnormal and sudden stop;
  • On February 21, 2020, or March 11, 2020.

A legal representative may submit a claim on behalf of a minor, an incapacitated person, or a deceased person. Supporting documents proving such authority will be required.

What does the compensation consist of?

The Settlement Agreement provides for the payment of compensation to eligible members to compensate for the hardships they experienced in connection with the events of February 21 and March 11, 2020.

Two types of compensation are provided:

  1. Compensation for common damages:
    • All eligible members are entitled to this category of compensation;
    • The exact amount of this compensation will be determined based on the total number of claims deemed valid.
  2. Compensation for the “Severity” category:
    • This is an additional payment provided when certain criterias are met;
    • Only one additional payment may be granted, if applicable, based on the category corresponding to the member’s situation.

These payments are structured according to various elements defined in the Settlement Agreement, notably by compensation categories to reflect specific situations.

What are the categories of compensation provided for, and what situations do they apply to?

The Settlement Agreement provides for several categories of compensation:

  • Common damages;
  • “Severity” compensation categories.

All eligible members are entitled to compensation for common damages.

In addition to this compensation, additional compensation may be awarded under the “Severity” compensation categories when certain specific criterias are met and supported by the documents provided.

Members who left Mont Sainte Anne by ambulance on February 21, 2020 or March 11, 2020.

Severity 2 Members who received one of the following diagnoses in connection with the February 21 or March 11, 2020 event, as documented in their medical records:

  • Mild traumatic brain injury (MTBI);
  • Post-traumatic stress disorder (PTSD);
  • Fracture of a limb;
  • Complicated sprain;
  • A diagnosis of similar or equivalent severity, as determined by the Claims Administrator;
OR

Members who incurred pecuniary losses exceeding $15,000, supported by documentation satisfactory to the Claims Administrator.

Severity 3 Members who received one of the following diagnoses in connection with the February 21 or March 11, 2020 event, as documented in their medical records:

  • Thoracic fracture;
  • Vertebral fracture;
  • A diagnosis of similar or equivalent severity, as determined by the Claims Administrator;
OR

Members who incurred pecuniary losses exceeding $40,000, supported by documentation satisfactory to the Claims Administrator.

What is the amount of compensation based on the compensation category I fall into?

The table below outlines the different compensation categories and the amounts that may be awarded depending on the applicable situation.

How can I obtain my compensation?

To receive compensation, you must first submit a complete claim within the specified time frame, in accordance with the procedure applicable to your situation.

There are two possible scenarios:

Option 1 – You received an email from Proactio on May 20, 2026

You were identified from a list compiled by the Plaintiffs’ lawyers.

The procedure is as follows:

  1. Complete and submit your claim form by clicking on the link provided for this purpose in the email you received on May 20, 2026;
  2. Once your form is submitted, we will contact you by email to provide instructions for submitting the documents and supporting evidence to support your claim;
  3. Submit all required documents using the secure envelope accessible via the link provided in our email with instructions, no later than November 20, 2026.

Option 2 – You did not receive an email from Proactio on May 20, 2026

You can still submit a claim by following the steps below:

  1. Complete the claim form available here;
  2. Attach all required documents and supporting evidence based on your situation;
  3. Submit your claim form along with all required documents by email, fax, or mail no later than November 20, 2026.

Please note that regardless of which option applies to you, you must submit your claim form and all required documents by November 20, 2026, at the latest. Any claims submitted after this date will be rejected.

What do I need to provide with my claim?

The documents and supporting evidence you need to provide vary depending on your situation and the compensation category for which you have filed a claim.

*If a class member submitting a claim is not listed on the gondola passenger list, they will be contacted by the Claims Administrator, who will require proof that they were present in the L’Étoile Filante gondola (“Gondolas”) at Mont-Sainte-Anne on February 21, 2020, or March 11, 2020, when it came to a sudden stop;

The Claims Administrator may also ask you to provide any additional documents relevant to a “Severity” compensation category, or to prove that you were aboard the gondola lift if you are not listed on the passenger list.

Are additional documents required if I am the legal representative of a member who is a minor, incapacitated, or deceased?

Yes. If you are acting as the legal representative of a member who is a minor, incapacitated, or deceased, additional documents will be required to confirm your authority to act on their behalf.

For a minor (under 18 years of age):

  • Birth certificate of the minor

For an adult:

  • Power of attorney (private or notarized);
  • Protection mandate (mandate in case of incapacity) with judgment;
  • Court judgment appointing a tutor or curator.

For a deceased person:

  • Copy of the death certificate;
  • Copy of the will search from the Barreau du Québec;
  • Copy of the will search from the Chambre des notaires du Québec;
  • Proof that the person submitting the claim is the executor, namely:
    • For an estate with a notarized will or marriage contract: a certified copy of the notarized will or marriage contract naming the person as executor;
    • For an estate with a holographic will or a will made before witnesses: a copy of the will and a court judgment or a notarial verification minutes confirming that the will has been verified, and the registration of the executor’s appointment in the Register of Personal and Real Property Rights;
    • For any other estate without a will: the entry of the appointment of the liquidator in the Register of Personal and Real Property Rights and the declaration of heirs and transfer by death.

How do I submit my documents and supporting evidence?

The process for submitting documents and supporting evidence varies depending on your situation.

Option 1 – You received an email from Proactio on May 20, 2026

Once you have submitted your claim form, you will receive an email containing instructions on how to submit your documents.

The documents must be submitted securely using a secure envelope accessible via the link included in this email.

Option 2 – You did not receive an email from Proactio on May 20, 2026

You must submit your documents and supporting evidence at the same time as your claim form, using one of the available methods: email, fax, or mail.

What is the deadline to submit a claim?

The claim form must be submitted no later than November 20, 2026.

When will I receive my compensation?

Compensation will be paid to Class Members within 60 days of the end of the claim period.

Compensation will therefore be distributed between November 21, 2026, and January 19, 2027.

You will receive an email in advance to notify you.

How will I receive my compensation?

If your claim is approved, your compensation will be paid by check.

The check will be mailed to the address you provided on your claim form.
