Privacy Policy

In the course of providing its services, Proactio, a subsidiary of Raymond Chabot Grant Thornton LLP, collects, uses, discloses and retains personal information. Proactio takes the protection of personal information seriously and is committed to ensuring that the privacy of individuals is respected.

In this regard, the purpose of this privacy policy (hereinafter the " Policy ") aims to inform you of our practices regarding the collection, use, disclosure and retention of personal information.

Your consent may be express, implied, or provided by your authorized representative. By using our website or by transmitting your personal information to us, you consent to this Policy and to the collection, use, disclosure, and storage of your personal information in accordance with this Policy.

This Policy is designed to comply with applicable laws regarding the protection of personal information.

Who are we and what services do we provide?

We provide services in class actions and can play different roles in the context of a class action.

We will mainly act as claims administrators and will then be appointed by the Superior Court of Quebec.

We may be mandated by one or more parties to the class action to disseminate notice campaigns to class members whose dissemination plan and notice content will have been approved by the Superior Court of Quebec.

We may also be mandated by one or more parties to the class action to act as an expert to evaluate the size of the group or the amounts at stake in a class action.

Collection of personal information

We limit the personal information we collect to that which we deem necessary to fulfill our various mandates in class actions.

In the course of our activities, we may collect certain personal information about you.

As the claims administrator, we will receive your claim, including all of the information you provide on your claim form and all of the evidence you submit in support of that claim. The personal information collected will sometimes include medical information if that information is relevant to your claim. By providing us with your personal information, you consent to its processing in accordance with this Policy and authorize Proactio and its service providers, if any, to process your personal information as set forth below.

In some cases, your personal information will be shared with us by a party or parties to the class action. This transmission of data will normally occur following our appointment as administrator or following the approval of notices to class members by the Superior Court of Quebec.

In addition, when you visit our website or contact us, we may collect the following categories of personal information, among others:

  • Identity information such as your first and last name.
  • Contact information such as your mailing address, telephone number and email address.
  • Information relating to the use of our website such as your browser's cookies, IP address, language of correspondence, date and time of your visits and pages viewed.
  • Any other personal information you provide.

Use of personal information

The personal information we collect is primarily used to provide our services in the context of class actions relevant to you. We also use it to meet our legal obligations.

We also use your personal information, with your consent or on another legal basis, to:

  • Respond to your inquiries or keep you informed.
  • Send you our newsletter or other communications. You may unsubscribe at any time from newsletters sent for marketing purposes.
  • To personalize or enhance your experience on our website.
  • Any other use permitted or required by applicable law.

Retention

We retain personal information collected only as long as necessary to fulfill the purposes for which it was collected, or as permitted or required by law.

Disclosure

We will not disclose your personal information for purposes other than those for which it was collected, except with your consent, as required by a court order or as permitted or required by law.

We may hire third parties to process personal information for the purposes identified above, such as vendors or partners who provide us with website services, application development, hosting and certain other services. In such situations, these third parties may have access to personal information. We limit the information provided to these third parties to only that which is necessary for them to perform their services. In addition, our contracts with these third parties ensure that they maintain the confidentiality and privacy of your information.

Some of these partners or vendors may be located in other countries. Your personal information may be processed, accessed, or stored outside of Canada. In accordance with applicable law in such jurisdictions, our partners or vendors may be required to disclose information in response to valid requests from governments, regulators, courts, and law enforcement authorities.

Security

We are committed to ensuring the confidentiality and protection of the personal information we hold. To do so, we apply physical, organizational, contractual and technological security measures that are generally applied and recognized for this purpose.

All service providers and suppliers who may be required to process your personal information are also required to comply with these security measures.

We have also taken steps to ensure that only those individuals working on the specific files about you or staff members needing to know have access to your personal information.

Links to third party websites

Our websites may provide links to third party websites. We have no control over the confidentiality or privacy practices of the operators of these websites. It is your responsibility to learn about their privacy and data protection policies.

Your rights

You have certain rights with respect to your personal information. You may:

      1. you may be informed of the existence, use and disclosure of your personal information and you may have access to this personal information within a reasonable time. You may also request that the computerized personal information you have provided to us be communicated to you or transferred to another organization in a structured and commonly used technological format;
      2. ask us to correct such information if it is inaccurate;
      3. withdraw your consent to its disclosure or use, subject to applicable law, and;
      4. ask us to stop disseminating your personal information and to de-index any link attached to your name which gives access to this information if this dissemination contravenes the law or a court order.

To exercise these rights, all requests must be made in writing and addressed to our Privacy Officer at the address indicated under the heading "Questions".

Such request will be responded to within thirty (30) days of receipt. If we are unable to respond within that time, we will notify you.

You have the right to file a complaint with the Commission d’accès à l’information, subject to the conditions provided for by applicable law.
