A proposed settlement has been reached in a class action that was certified by the Manitoba Court of King’s Bench. The Court will soon decide whether to approve that settlement.
The lawsuit alleges Manitoba improperly subjected people to segregation in Manitoba Provincial Custodial Facilities, causing them emotional, physical, and psychological harm.
Criteria
The class includes people who were inmates in Manitoba Provincial Custodial Facilities, and who were subjected to Segregation:
1. After September 12, 2006, as a Youth; or
2. After September 12, 2012:
a. For at least 15 consecutive days, or
b. While suffering from a Serious Mental Illness.
You are not eligible if:
× You previously opted out of the class action.
× You settled similar claims with Manitoba and signed a release.
What is the proposed settlement?
The parties have reached a proposed settlement. The proposed settlement provides for a fund of $129 million. Manitoba denies liability but has opted to resolve the class action without a trial.
Eligible class members may receive awards starting at $3,000 for adults and $9,000 for youth. Class members may be entitled to additional amounts if they were subjected to a prolonged period of segregation or if they suffered specific, provable harms while segregated. The maximum compensation available for class members is up to $100,000, depending on their circumstances.
The Court must approve this proposed settlement. The Court will decide whether to approve the proposed settlement and Class Counsel’s fees at a hearing on June 4, 2026.
What are my options at this stage?
All class members who do not opt out can voice their support for, or objections to, the proposed settlement.
Some class members can still opt out of this action.
In 2022, this action was certified for those placed in Segregation before May 4, 2022. These class members can no longer opt out of the action.
On February 19, 2026, this action was certified on behalf of those placed in Segregation after May 4, 2022. If this applies to you, your options are:
1. Do nothing
You do not need to do anything to remain in the class action. If you meet the class member criteria (see above), you are automatically signed up. If the Court approves the settlement, you will be able to make a claim for compensation at a later date.
You may also assist other Class members by informing anyone who could belong to the Class about this class action.

2. Support or Object to the proposed settlement by April 13, 2026.
If you want to voice your support or object to the proposed settlement, you can do so by submitting a Support or Objection Form. Your Support or Objection Form must contain certain things, like your name, address, and the reasons why you support or object to the settlement.

3. Opt Out by April 13, 2026.
You can exclude yourself from the class and get no money or benefits from the lawsuit, but keep your right to sue independently, subject to all the defences Manitoba could have raised to this class action.

Next steps
The Court will hold a hearing on June 4, 2026 to decide whether to approve the proposed settlement.
The Court has appointed Koskie Minsky LLP from Toronto to represent you and other Class Members as Class Counsel. You will not have to pay any of Class Counsel’s fees or expenses.
