On February 10, 2021, the Superior Court of Quebec authorized two class actions against Station Mont-Sainte-Anne Inc. on behalf of individuals affected by malfunctions of the gondola lift operated by Station Mont-Sainte-Anne Inc. that occurred on February 21 and March 11, 2020.
A settlement agreement, intended to fully and definitively resolve these class actions, was reached between the parties and approved by the Honorable Jacques G. Bouchard of the Superior Court of Quebec on April 1, 2026.
Criteria to respect
- You were inside the gondola lift at the Mont-Sainte-Anne ski resort;
- When it came to an abnormal and sudden stop;
- On February 21, 2020, or March 11, 2020.
What does the Settlement Agreement provide for?
The Settlement Agreement provides for the payment of a lump sum of $5,100,000.00 to fully and finally settle these two class actions as well as the claims of the class members.
This gross settlement fund will be used, in particular, to cover:
- Court costs;
- The Plaintiffs’ lawyers’ fees;
- Disbursements;
- Compensation to eligible members.
It is anticipated that compensation to members will be paid according to the following terms:
- A portion of the fund will be allocated to the payment of compensation under the “Common Damages” compensation category, paid to all eligible members;
- A portion of the fund will be allocated to the payment of additional awards under the “Severity” compensation categories, granted when the criteria set forth for certain categories established in the Settlement Agreement are met.
The amounts of awards that may be paid vary depending on the applicable compensation category and the information provided in support of each claim.
How to complete a claim?
The steps to submit your claim vary depending on your situation. Please review the option that applies to you.
Option 1 – You received an email from Proactio on May 20, 2026
You were identified as a potential member from a list compiled by the Plaintiffs’ lawyers.
The procedure is as follows:
- Complete and submit your claim form by clicking on the link provided for this purpose in the email you received on May 20, 2026;
- Once your form is submitted, we will contact you by email to provide instructions for submitting the documents and supporting evidence to support your claim;
- Submit all required documents using the secure envelope accessible via the link provided in our email with instructions, no later than November 20, 2026.
Option 2 – You did not receive an email from Proactio on May 20, 2026
You can still submit a claim by following the steps below:
- Complete the claim form available here;
- Attach all required documents and supporting evidence based on your situation;
- Submit your claim form along with all required documents by email, fax, or mail no later than November 20, 2026.
Please note that regardless of which option applies to you, you must submit your claim form and all required documents by November 20, 2026, at the latest. Any claims submitted after this date will be rejected.
What will be the compensation?
The amount of compensation to which you may be entitled depends on your circumstances and the category of compensation applicable to your claim.
Two types of compensation are provided:
- Compensation for general damages:
- All eligible members are entitled to this category of compensation;
- The exact amount of this compensation will be determined based on the total number of claims deemed valid.
- Compensation for the “Severity” category
- This is an additional compensation provided when certain criteria are met;
- Only one additional compensation may be granted, if applicable, based on the category corresponding to the member’s situation.

When will the compensation be distributed?
The compensation amounts will be paid to members within 60 days of the end of the claim period.
As such, compensation is scheduled to be distributed between November 21, 2026, and January 19, 2027.
