Neighborhood disturbances in La Prairie/Candiac

Pierre Robillard v. Ecoservices Tria Inc. et al.

On October 10, 2025, the Superior Court of Quebec approved a settlement agreement concerning neighborhood disturbances experienced by residents living in three areas located near the construction and demolition debris landfill and sorting center operated by Écoservices Tria Inc. in La Prairie between 2010 and 2016.

The Settlement Agreement has two parts:

– The first part, covering the period from February 12, 2010, to December 31, 2016, provides for the payment of $2,200,000.00 in compensation to members according to the distribution plan in Appendix B of the Settlement Agreement.
– The second part, for the future, provides for the restoration of the former landfill site and its return to its original condition by Écoservices Tria Inc. and Gestion Tria.

Criteria to be met

You resided between February 12, 2010, and December 31, 2016;
In one of the following three sectors:

The « A » sector of the City of Candiac;
OR
The « P » sector of the City of Candiac;
OR
The sector know and designated as the Faubourg du Golf de La Prairie.

The deadline for claims is july 21, 2026

What does the Settlement Agreement provide for? 

The agreement provides the following, as a complete and final settlement of all claims related to the class action:

– Écoservices Tria Inc., Gestion Tria Inc., and the City of La Prairie will jointly pay the members the total amount of $2,200,000 in capital, interest, costs, fees, and taxes, distributed as follows :

o $2,000,000 payable by La Prairie;
o $200,000 payable by Écoservices and Gestion Tria.

– Écoservices Tria Inc. undertakes to withdraw their lawsuit intended with the Quebec Administrative Tribunal (TAQ) against Order No. 691-A issued by the MELCCFP.

– The Minister orders Écoservices to cease all dumping or disposal of residual materials on the surface of the former landfill site, to cease the development of any unauthorized platform on that same site, to remove all waste materials from the surface of the former landfill site and to transport them to an authorized site, all in the allotted timeframe and in accordance with the provisions of the LQE, the regulations, authorizations, and terms and conditions set out in the Order.

The collectively recovered amount of $2,200,000 will be distributed in accordance with the Allocation and Distribution Plan, which provides payment, in order, for:

– Legal costs, including the costs of notifying members and the remuneration of the Administrator responsible for the claims process and the distribution of compensation funds;
– Class counsel’s fees totalizing 30% of the funds;
– The claimant’s disbursements;
– The payment of compensation to Class members according to their claims, as accepted by the Administrator.

A deduction in accordance with the Regulation, respecting the percentage deducted by the Class Action Assistance Fund (FAAC), will be made from any remaining balance.

Which civic addresses are covered by the Settlement agreement?

You can find the list of civic addresses covered by the Settlement Agreement here.

Please note that it is not enough to reside or have resided at one of the addresses on the list of civic addresses covered by the Settlement Agreement; you must have resided there between February 12, 2010, and December 31, 2016, in order to be eligible for compensation.

If you cannot find your address on the list of civic addresses covered by the Settlement Agreement, you are not eligible for compensation under this class action. You cannot therefore submit a claim.

What will be the compensation?

Your compensation, if you are eligible, will be calculated based on the area in which you resided and prorated according to the number of days during the years of occupancy from February 12, 2010, to December 31, 2016.

When will the compensation be distributed ?

The compensation amount will be paid to members within 30 days of the end of the claim period.

Therefore, compensation will be distributed between July 22, 2026, and August 21, 2026.
