What is a class action lawsuit? 

A class action is a legal proceeding that allows one person to act on behalf of a group of people with identical or similar legal claims. A person called the “class representative” is authorized to act on behalf of all members of the class in court. This avoids each member having to file an individual lawsuit: the Court handles the case in a single proceeding for all concerned members.

What is the context of this class action?

A class action has been authorized against exo and the ARTM in connection with service disruptions on the Deux-Montagnes and Mascouche train lines between November 1, 2017 and February 28, 2018. The settlement agreement was approved by the Superior Court of Quebec on March 16, 2026.

Who is eligible for compensation?

All individuals, including minors, incapacitated persons, and deceased persons, who meet all of the following criteria:

You may be eligible if:

  • You purchased a transit fare (monthly, annual, or booklet) in 2017 and/or 2018.
  • You used this fare to travel on one or both of the following lines:
    • Deux-Montagnes train line;
    • Mascouche train line.
  • You travelled between November 1, 2017 and February 28, 2018.

A legal representative may submit a claim on behalf of a minor, an incapacitated person, or a deceased person. Supporting documents proving such authority will be required.

What are the compensation amounts?

The amounts vary according to the type of transit fare used, the user category and the user’s city or municipality of residence at the time, as shown in the tables below.

A maximum amount of $75,000.00 will be paid to Trajectoire Québec as indirect compensation for Members who purchased one or more 1-trip tickets, subject to deductions provided for by law in favor of the Fonds d’aide aux actions collectives.

How do I submit a claim?

The fastest and easiest way is to complete the online form.

Depending on your situation, you will need to provide certain information and documents:

Option 1 – You received an email from Proactio in July 2025

You were identified based on lists compiled by exo and the members’ lawyers prior to July 2025.

IMPORTANT: If you have been contacted by Proactio by email, make sure to use the same email address to submit your claim.

  1. Complete the online form;
    • You will be asked to make certain declarations directly in the form, including your city or municipality of residence during the relevant period, the type of transit fare purchased (monthly, annual, or booklet), and, if applicable, the number of booklets purchased.
  2. No additional proof is required.

If you are unsure whether you received the Proactio email in July 2025, it is recommended that you proceed under Option 2.

Option 2 – You did not receive an email from Proactio in July 2025

You can still submit a claim.

  1. Complete the online form;
    • You will be asked to make certain declarations directly in the form, including your city or municipality of residence during the relevant period, the type of transit fare purchased (monthly, annual, or booklet), and, if applicable, the number of booklets purchased.
  2. Provide a valid official government-issued ID with photo and date of birth;
  3. Provide a proof of address covering the relevant period.

What documents must I provide with my claim?

  • If you received an email from Proactio in July 2025:
    No documents are required.
  • If you did not receive an email from Proactio in July 2025 or are unsure if you did:
    You must upload the required documents listed below.

Required documents

  • Valid government-issued photo ID, such as:
    • Health insurance card
    • Driver’s licence
    • Passport
    • Etc.
  • Proof of address covering the relevant period, such as:
    • Deed of purchase
    • Lease agreement
    • Utility bills (electricity, telephone, mobile, cable, insurance)
    • Municipal or school tax bills
    • Provincial or federal notice of assessment
    • Pay stubs or statements of earnings
    • Bank statements
    • Driver’s licence or vehicle registration
    • Government-issued correspondence
    • Permanent resident card
    • Any other document demonstrating your place and period of residence with postal code

Claims submitted by a representative of a class member

If you submit a claim on behalf of another class member, you must provide proof of your authority to act, depending on the situation:

  • For a minor (under 18 years of age):
    • Birth certificate of the minor
  • For an adult:
    • Power of attorney (private or notarized)
    • Protection mandate (mandate in case of incapacity) with judgment
    • Court judgment appointing a tutor or curator
  • For a deceased person:
    • Official death certificate
    • Will searches from the Chambre des notaires du Québec and the Barreau du Québec

Depending on the case, you must also provide:

  • A certified copy of a notarial will or marriage contract
  • For a holograph or witnessed will: a copy of the will and a court judgment or notarial verification minutes
  • For an estate without a will: a declaration of heirs

What proof of address is accepted?

The following documents are considered valid, provided they show your name, address, and the date of the document (you may remove or redact other information that you consider confidential such as account numbers or outstanding amounts):

  • Deed of purchase;
  • Lease;
  • Utility bills;
  • Municipal or school tax bills;
  • Notices of assessment;
  • Pay stubs;
  • Bank statements;
  • Driver’s licence or vehicle registration;
  • Government-issued correspondence;
  • Permanent resident card;
  • Any other document demonstrating your residence and the relevant period.

Which cities are included for the acceptance of proof of address?

Proof of address from the following cities will be accepted as part of the claim process:

What compensation is provided for single tickets?

Members who purchased one or several 1-trip tickets will not receive direct individual compensation.

A maximum amount of $75,000 will be paid to Trajectoire Québec as indirect collective compensation for users who purchased 1-trip tickets during the relevant period, subject to deductions provided for by law in favor of the Fonds d’aide aux actions collectives.

What is the deadline to submit a claim?

The online form must be completed on October 26, 2026, at the latest.

When will the payment be made?

Payments will be issued within 60 days following the end of the claims period.

Accordingly, distribution of compensation will take place between 2026 and 2026.

If the total amount of valid claims exceeds the available funds, compensation amounts will be adjusted on a pro rata basis.

How will I receive my payment?

Payment will be made by Interac e-Transfer sent to your mobile phone.

What are the fees charged by the class members' lawyers under this settlement agreement?

In the judgment approving the Settlement Agreement, the Superior Court of Québec concluded that the legal fees requested by class counsel were fair and reasonable.

Accordingly, the Court approved:

  • Extrajudicial legal fees equivalent to 23.8% of the amounts recovered, namely $1,000,000, plus applicable taxes. This percentage is lower than the initially contemplated rate of 30%, as class counsel voluntarily agreed to reduce their fees.

Of these fees, class counsel must reimburse the Fonds d’aide aux actions collectives an amount of $125,446.05, corresponding to the full reimbursement of the financial assistance granted.
