Commuter train delays winter 2017-2018

Konstas v. Réseau du transport métropolitain ("exo") et al.

On April 1, 2020, the Superior Court of Quebec authorized Mr. Spiros Konstas to file a class action against the Réseau de transport métropolitain (“exo”) and the Autorité régionale de transport métropolitain (“ARTM”) in connection with service disruptions on the Deux-Montagnes and Mascouche train lines between November 1, 2017 and February 28, 2018.

A settlement agreement, without admission of liability on the part of exo or ARTM, has been reached between the parties and was approved by the Honourable Céline Legendre, J.S.C., of the Superior Court of Quebec on March 16, 2026.

Criteria to be met

  • You have purchased a transit fare (monthly, annual or booklet).
  • You have used this fare to travel on the following line(s):
    • Deux-Montagnes train line;
    • Mascouche train line;
  • You travelled between November 1, 2017 and February 28, 2018.

The deadline to submit a claim is October 20, 2026.

What does the settlement agreement provide for?

The settlement agreement provides for the payment of a maximum amount to eligible members who purchased a transit fare to travel on the Deux-Montagnes or Mascouche train lines between November 1, 2017 and February 28, 2018.

The amounts vary according to the type of transit fare used, the user category and the user’s city or municipality of residence at the time, as shown in the tables below.

Other amounts provided for in the settlement agreement

A maximum amount of $75,000 will be paid to Trajectoire Québec as indirect compensation for Members who purchased one or more 1-trip tickets, subject to deductions provided for by law in favor of the Fonds d’aide aux actions collectives.

The agreement also provides for an amount to be paid to the members’ lawyers as compensation for their fees and the claim administrator, drawn from the settlement fund.

How to complete a claim?

The fastest and easiest way to submit a claim is by completing the online form.

Depending on your situation, you will need to provide certain information and documents.

 

Option 1 – You received an email from Proactio in July 2025

You were identified from lists compiled by exo and the members’ lawyers prior to July 2025.

In this case, the process is simplified:

– Your city or municipality of residence between November 1, 2017 and February 28, 2018;

– The type of transit fare purchased (monthly, annual or booklet);

– The number of booklets purchased, if applicable.

  • No additional proof is required;
  • Submit your claim before before October 20, 2026.

 

Option 2 – You did not receive an email from Proactio in July 2025

You can still submit a claim by providing certain documents:

– Your city or municipality of residence between November 1, 2017 and February 28, 2018;

– The type of transit fare purchased (monthly, annual or booklet);

– The number of booklets purchased, if applicable.

  • Also submit the following documents to support your claim:

– Valid government-issued ID with photo and date of birth;

– Official proof of address covering the relevant period with postal code.

  • Submit your claim and required documents before October 20, 2026.
