Commuter train delays winter 2017-2018

Konstas v. Réseau du transport métropolitain ("exo") et al.

On April 1, 2020, the Superior Court of Quebec authorized Mr. Spiros Konstas to file a class action against the Réseau de transport métropolitain “exo” and the Autorité régionale de transport métropolitain “ARTM” in connection with service disruptions on the Deux-Montagnes and Mascouche train lines between November 1, 2017 and February 28, 2018.

A settlement agreement, without admission of liability on the part of exo or ARTM, has been reached between the parties, subject to approval by the Superior Court on August 14, 2025.

Criteria to be met

  • You have purchased a transit fare (monthly, annual or booklet).
  • You have used this fare to travel on the following line(s):
    • Deux-Montagnes train line;
    • Mascouche train line;
  • You travelled between November 1, 2017 and February 28, 2018.

What does the settlement agreement provide for?

The settlement agreement provides for the payment of a maximum amount to eligible members who purchased a transit fare to travel on the Deux-Montagnes or Mascouche train lines between November 1, 2017 and February 28, 2018.

The amounts vary according to the type of transit fare used, the user category and the user’s city or municipality of residence at the time, as shown in the tables below.

Other amounts provided for in the settlement agreement

An amount of $75,000 will be paid to Trajectoire Québec as indirect compensation for Members who purchased one or more 1-trip tickets.

The agreement also provides for an amount to be paid to the members’ lawyers as compensation for their fees, drawn from the settlement fund.

Settlement agreement hearing

The settlement agreement must be approved by the Superior Court of Quebec.

An approval hearing on the settlement agreement will be held before the Honourable Céline Legendre, J.S.C., on August 14, 2025, at 9:30 a.m. in room 15.08 of the Montreal Courthouse (1 Notre-Dame Street East, Montreal, Quebec H2Y 1B6).

➡ Members are not required to attend the hearing in order to benefit from the settlement agreement.

Your presence at the hearing is not mandatory. You may, however, attend the hearing in person, or virtually via the following link: TEAMS links to commercial, civil and family courtrooms at the Palais de justice de Montréal.

If you disagree with the settlement agreement or with the proposed distribution of the balance, you may inform the Court of your objection at the hearing either in person or virtually via the above-mentioned link.

A new notice will be published at the time of the final judgment on the approval of the settlement. The class action website will also be updated to reflect any new relevant information.
